“Live Like a Trump” Facebook Giveaway
Each day from Monday, December 29, 2014 to Friday, January 2nd, 2015 a trivia question will be posted to the Luvo Facebook page. Questions will be based on a mix of food related trivia and The Celebrity Apprentice show trivia. Participants must comment on the Facebook post to enter the sweepstakes. One (1) winner will be randomly selected following the end of the Sweepstakes Period (defined below), and announced on Facebook on Monday, January 5, 2015. Rules/Disclaimer: This promotion is open to legal U.S. residents, ages 18 and above. Void where prohibited.
OFFICIAL RULES
This “Live Like a Trump” (“Sweepstakes”) is sponsored by Luvo (“Sponsor” or “Luvo”) and is governed by these official rules (“Official Rules”). By participating in the Sweepstakes, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Sweepstakes, as determined by Sponsor and its agents, are final in all respects. The Sweepstakes is subject to all federal, state and local laws and regulations and is void where prohibited by law.
This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Any questions, comments or complaints regarding the promotion will be directed to Sponsor, not Facebook.
ELIGIBILITY
The Sweepstakes is open to legal U.S. residents who are eighteen (18) years of age or older at the time of entry. Sponsor has the right to verify the eligibility of each entrant. No purchase or payment of any kind is necessary to enter or win. Employees, representatives or agents of Sponsor and its subsidiaries and affiliates, media partners and advertising and promotional agencies and persons with whom any of the aforementioned are domiciled are not eligible to enter the Sweepstakes.
SWEEPSTAKES PERIOD
The Sweepstakes begins on December 29, 2014 at 9:00 AM PST and ends on January 2, 2015 at 5:00PM PST (“ Sweepstakes Period”). For eligibility, all entries (submissions) must be received during the Sweepstakes Period. Sponsor reserves the right to extend or shorten the Sweepstakes at their sole discretion.
HOW TO ENTER
NO PURCHASE IS NECESSARY.
During the Sweepstakes Period, you can enter by commenting on the Facebook post. Content of comment does not affect chances of winning the Grand Prize. After commenting on the Facebook post, the entrant will receive one (1) entry into the drawing. Each time an entrant submits a valid entry during the Sweepstakes Period, the entry is entered into the draw. There is a maximum of one entry per person per Facebook account. You may, however, enter on as many days as you wish during the Sweepstakes Period.
PRIZES:
Grand prize will include airfare for two (2) passengers round trip to New York City from anywhere in the US, voucher for a two (2) night stay at the Trump International Hotel & Tower New York, voucher for airport transfers for two (2) passengers and a meal voucher for two (2) at Locanda Verde (“Grand Prize”). Maximum value is approximately $2,600 USD.
Terms and conditions may apply. Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Official Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the respective prize winner. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS SOLELY THE RESPONSIBILITY OF THE WINNER.
RANDOM DRAW OF THE DAILY PRIZES
Each time an entrant submits a valid entry during the Sweepstakes Period, the entry is entered into the draw. The draw will be done by random selection from the eligible entries. Following the Sweepstakes Period the draw will take place on Monday, January 5th, 2015, and will be announced on the Luvo Facebook page the same day. Odds of winning the Grand Prize will depend on the number of eligible entries received during the Sweepstakes Period.
CLAIMING OF PRIZE
In order to be declared a winner and be able to claim the Grand Prize, the entrant selected by random draw will be contacted within two (2) business days of the draw by the Sponsor or one of its agents or representatives and must confirm acceptance as a selected entrant within five (5) calendar days of contact. If a selected entrant cannot be contacted, another entrant will be selected by way of random draw. Upon the request of the Sponsor, the potential winner may be required to return an Affidavit of Eligibility, Release and Prize Acceptance Form. If a potential winner fails to comply with these official rules, that potential winner will be disqualified. The entrant must confirm flight travel before December 31, 2015, at which time this component of the prize package will expire.
ADDITIONAL LIMITATIONS
The Grand Prize is non-transferable. No substitution or cash equivalent of prizes is permitted. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the Sweepstakes, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Sweepstakes is unlawful and subject to possible legal action by Sponsor. Sponsor reserves the right to terminate, suspend or amend the Sweepstakes, without notice, and for any reason, including, without limitation, if Sponsor determines that the Sweepstakes cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Sweepstakes. In the event any tampering or unauthorized intervention may have occurred, Sponsor reserves the right to void suspect entries at issue. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.
Entrants agree to be bound by all decisions of the Sponsor regarding the Sweepstakes, which shall be final and binding in all respects.
RELEASE, INDEMNIFICATION AND LIMITATION OF LIABILITY
BY ENTERING THE SWEEPSTAKES, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS SPONSOR, NBCUNIVERSAL MEDIA, LLC, AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES, THE FACEBOOK PLATFORM, ADMINISTRATOR, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE. SPONSOR AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE SWEEPSTAKES.
PUBLICITY
By accepting the Grand Prize, each declared winner consents to the use of his/her Facebook entry, user name, first name, statements, city of residence and/or photograph or other likeness in any advertising or promotional activities carried out in any medium by the Sponsor and/or its advertising agencies, without further notice or compensation.
DISPUTES; GOVERNING LAW.
The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules and/or the Sweepstakes. Any controversy or claim arising out of or relating to these Official Rules and/or the Sweepstakes shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of Georgia.
THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF GEORGIA WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES.
