Luvo in Flight

Send in a photo of your “Luvo In Flight” meal taken from any participating Delta airlines flight for your chance to win a month’s supply of Luvo retail entrees! A winner will be randomly selected on the 15th day of every month at 9:00 AM PST.

OFFICIAL RULES

This “Win Luvo for a Month Contest” (“Contest”) is sponsored by Luvo USA, LLC (“Sponsor” or “Luvo”) and is governed by these official rules (“Official Rules”). By participating in the Contest, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Contest, as determined by Sponsor and its agents, are final in all respects. The Contest is subject to all federal, state and local laws and regulations and is void where prohibited by law.

This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Twitter or Instagram. Any questions, comments or complaints regarding the promotion will be directed to Sponsor, not Facebook, Twitter or Instagram.

ELIGIBILITY

The Contest is open to legal U.S. residents who are eighteen (18) years of age or older at the time of entry. Sponsor has the right to verify the eligibility of each entrant. No purchase or payment of any kind is necessary to enter or win.  Employees, representatives or agents of Sponsor and its subsidiaries and affiliates, media partners and advertising and promotional agencies and persons with whom any of the aforementioned are domiciled are not eligible to enter the Contest.

CONTEST PERIOD

The Contest begins on Oct 1st 2015 and ends on Oct 1 2016 (“Contest Period”). For eligibility, all entries (submissions) must be received during the Contest Period. Sponsor reserves the right to extend or shorten the contest at their sole discretion.

HOW TO ENTER

NO PURCHASE IS NECESSARY.

During the Contest Period, you can enter by either sharing a photo of your Luvo In Flight meal on Twitter or Instagram along with the hashtag #LuvoInFlight and tagging @luvoinc. After submitting your Luvo In Flight photo, the entrant will receive one (1) entry into the drawing.

Each time an entrant submits a valid entry during the Contest Period, the entry is entered into the draw.  There is a maximum of one entry per day per person per Twitter or instagram account. You may, however, enter on as many days as you wish during the Contest Period.

PHOTO ENTRY RULES

Your photo entry must:

  1. be a photo of your Luvo In Flight meal taken on a Delta airlines flight;
  2. be posted directly to your Twitter feed and include the hashtag #LuvoInFlight and tag @luvoinc or to your Instagram application with the caption #LuvoInFlight in your photo;
  3. be your original creation, and be a photograph taken solely by you. Reproducing, modifying, enhancing or altering a third party’s pre-existing work does not qualify as your original creation;
  4. not violate the rights of any third party, including, but not limited to copyright. For example, your photo entry must not defame, infringe or violate publicity or privacy rights of any person, living or deceased, or otherwise infringe upon any person’s, entity’s or organization’s personal or proprietary rights, including but not limited to, intellectual property rights;
  5. not have been published previously, used commercially, submitted to another competition or contest, or won any other award;
  6. be in “good taste” and in keeping with Luvo’s brand image and must not be explicit or offensive, as determined by Luvo, in its sole and absolute discretion;
  7. not contain any commercial content that promotes any product or service;
  8. not be false, inaccurate or misleading;
  9. not violate any law or regulation;
  10. not be libelous, threatening or harassing;
  11. not instigate others to commit illegal activities or violate human rights; and
  12. not contain any viruses, worms, or other interfering computer programming

You must warrant that your photo entry meets the Photo Entry Rules, set out above. Luvo reserves the right to deem ineligible and exclude from the Contest any photo entry that Luvo, in its sole and absolute discretion, determines does not meet the Photo Entry Rules.

Your right to submit a photo entry must not be restricted in any way. You must be able to provide legal releases for use of your photo entry by Luvo in any format, and materials related to the Contest, including in relation to any third party’s name, likenesses or work (“Third Party Elements”) included in your photo entry.

LUVO’S RIGHT TO USE PHOTO ENTRY

You acknowledge that your photo entry will immediately appear in your Twitter feed or Instagram application after it is posted and may appear in other electronic and print materials related to the Contest, including promotional materials. By posting a photo using the designated contest hashtag and @Luvoinc’s  username, you irrevocably, perpetually, and without limitation, grant Luvo the right to use, publish, adapt, sub-license, edit, dispose of, and/or modify such photo entry and the concepts and Third Party Elements embodied therein in any way, in commerce, and in any and all media worldwide in electronic and print materials related to the Contest, and waive all your rights, including moral rights, in the photo entry, without notice or compensation, and agree that you may be required to sign a release to that effect.

Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise, illicit means to enter the contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating multiple Twitter accounts, shall be deemed as tampering and may disqualify you from entering, participating, winning prizes (defined herein), and preclude you from participating in future contests and promotions, at the sole discretion of Luvo. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions these rules will be judged void. All entries become the property of Luvo upon receipt and none will be returned. Proof of transmission (screenshots or captures, etc.) does not constitute proof of receipt.

PRIZES:

Monthly Prizes: Thirty (30) Luvo retail frozen entrée coupons.  Each coupon entitles the prize winner to redeem one Luvo retail frozen entrée from a participating retailer. Maximum value is approximately $180.00.

Terms and conditions may apply. Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Official Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the respective prize winner. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS SOLELY THE RESPONSIBILITY OF THE WINNER.

RANDOM DRAW OF THE MONTHLY PRIZES

Each time an entrant submits a valid entry during the Contest Period, the entry is entered into the draw. Once an entry has been selected as part of the monthly draws, it will not be eligible for subsequent monthly draws.

Each draw will be done by random selection from the eligible entries.

During the Contest Period the twelve (12) monthly draws will take place on the 15th of the month with the first monthly draw taking place on November 1st 2015 and the last monthly draw taking place on Oct 1 2016 .

Odds of winning a Monthly Prize will depend on the number of eligible entries received during the Contest Period.

CLAIMING OF PRIZE

In order to be declared a winner and be able to claim a Monthly Prize, each of the entrants selected by random draw will be contacted within two (2) business days of the draw by the Sponsor or one of its agents or representatives and must confirm acceptance as a selected entrant within five (5) calendar days of contact. If a selected entrant cannot be contacted, another entrant will be selected by way of random draw.

Upon the request of the Sponsor, the potential winner may be required to return an Affidavit of Eligibility, Release and Prize Acceptance Form. If a potential winner fails to comply with these official rules, that potential winner will be disqualified.

ADDITIONAL LIMITATIONS

The Monthly Prize is non-transferable. No substitution or cash equivalent of prizes is permitted. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the Contest, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Contest is unlawful and subject to possible legal action by Sponsor. Sponsor reserves the right to terminate, suspend or amend the Contest, without notice, and for any reason, including, without limitation, if Sponsor determines that the Contest cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Contest. In the event any tampering or unauthorized intervention may have occurred, Sponsor reserves the right to void suspect entries at issue. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.

Entrants agree to be bound by all decisions of the Sponsor regarding the Contest, which shall be final and binding in all respects.

RELEASE, INDEMNIFICATION AND LIMITATION OF LIABILITY

BY ENTERING THE CONTEST, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES, THE FACEBOOK PLATFORM, ADMINISTRATOR, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE CONTEST AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE. SPONSOR AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE CONTEST.

PUBLICITY

By accepting a Monthly Prize, each declared winner consents to the use of his/her Twitter photo entry, Instagram photo entry, user name, first name, statements, city of residence and/or photograph or other likeness in any advertising or promotional activities carried out in any medium by the Sponsor and/or its advertising agencies, without further notice or compensation.

DISPUTES; GOVERNING LAW.

The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules and/or the Contest. Any controversy or claim arising out of or relating to these Official Rules and/or the Contest shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of Illinois.

THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF GEORGIA WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES.
